All photos uploaded on the site shall be made accessible to other users for viewing and voting purposes. Users shall also be able to transmit your content on or through the website and any other electronic communication media or technology (e.g. Android Smartphones and Tablets), now known or later developed, for the entire period in which your photos are hosted on the game website. Please note that MM ARCADE has in place an Anti-Screenshot Feature for the purpose of protecting user content. Nevertheless, due to the nature of the internet and digital media, data transmitted including your content, may not be protected against the risks of misappropriation and/or piracy., for which MM Arcade shall not be held liable. In addition, for the entire period for which your content is hosted on our game website, you hereby agree to grant MM Arcade, the non-exclusive free right and license to reproduce and display your content, in whole or in part, and to display, perform, reproduce, adjust and/or transmit the same via the features that enable the website to be accessed both on the internet and through any other electronic communication media or technology, now known or later developed.

You covenant to not use or exploit the game website content in any manner inconsistent with any of the rights granted or restrictions set forth herein including and without limitations to prohibitions on downloading, redistribution, alteration, deletion and deactivation of any content protection mechanisms. LIMITATION OF LIABILITY
MM Arcade shall not be liable to you for any indirect or consequential losses which may be incurred by you. This shall include;
(i) any loss of profit (incurred directly or indirectly);
(ii) any loss of goodwill or business reputation;
(iii) any loss of opportunity;
(iv) any loss of data;
(v) any loss or damage which you may incur by reason of any reliance placed by you on the completeness, accuracy or existence of any advertising, or as a result of any relationship or transaction between you and any advertiser or sponsor whose advertising appears on the website; any changes which MM Arcade may make to the website or for any permanent or temporary cessation in the provision of the service(or any features within the website); the deletion of; corruption of; or failure to store, any content and other communications data maintained or transmitted by or through your use of our game website; your failure to provide MM Arcade with accurate account information; your failure to keep your password or MM Arcade account details secure and confidential. The limitations on MM Arcade’s liability in this regard will apply whether or not it has been advised or should have been aware of the possibility of any such losses arising.
COPYRIGHT NOTIFICATIONS

REGISTRATION AND ACCESS
To use any of the game website’s features and to participate in the competitions, you must set up an account using the online registration form. You may access your account by clicking login on the homepage and you can enter your username and password in the login fields on the login page. You are responsible for keeping your username and password secured. Registration entitles you to use the website. We reserve the right to terminate your account at any time. Failure to comply with the terms herein or any other policy of MM Arcade may result in access to your personal page being temporarily or permanently suspended, immediately and without notice, or in the deactivation of your account, without prejudice to any other rights we may have.
ABILITY TO ACCEPT TERMS AND CONDITIONS
Children under the age of (18) Eighteen years are not permitted to register with MM Arcade. If you are under 18 years, do not register, use or access the MM Arcade website at any time or in any manner. If you are the parent or legal guardian of a child under 18 years, and that child has somehow registered with the game website, please send an email to [email protected] for instructions on how to cancel your child’s registration. In the e-mail, please include your full name and address, your child’s full name and address, your relationship with the child, contact phone number and e-mail address and a signed statement that you are the child’s legal guardian or parent. MM Arcade reserves the right to seek additional information to verify your identity and status in relation to the child. MM Arcade will use this information solely for the purpose of verifying that you are the child’s parent/legal guardian.
CONTEST FEES/CHARGES.
MM Arcade has an In-Game Currency called M-Cash. A user’s M-Cash is stored in the game website’s app feature called M-Wallet. Every user has his/her own individual M-Wallet. MM Arcade runs a point-based system that allows users to accumulate points which are credited as M-Cash in a user’s M-wallet when they join or win a game. All new users of MM Arcade shall be credited with a voucher of M1000 at the conclusion of their registration. Users can also buy additional points as the need arises. M-Cash is sold at the rate of $1 for M1000 and this is the least amount of M-cash a user can purchase at any given time. All payments for the purchase of M-cash shall be processed through the PayPal platform. M-Cash is only relevant inside the app and cannot be sold for, exchanged with or converted to real currency. If a user’s account is deleted, they also lose all their accrued points and M-cash.
CONTEST GUIDELINES
The MM Arcade game website is set to run 24hrs daily. Users who desire to participate in any of the MM Arcade contests would be required to upload their photos in accordance with the nature of the contest they are interested in. Users must ensure that the photos they upload are not offensive or contravene the terms herein or else such photos will not be selected. Users would be required to pay a fee in M- Cash (in dollars or its equivalent) to enter the contest. The cost of each contest is reflected in the contest section. Where a user possesses insufficient M-cash for a contest in their M-wallet, they can purchase some more M-Cash to complete the fee. For each game paid in dollar, users are entitled to earn M-Cash bonuses. Only users who desire to participate in the MM Arcade contests are required to pay contest fees. Where a user decides to opt out of the contest before the contest is open to voters, he will be entitled to a refund within 24hrs. However, if a participant’s photos are not selected due to being in contravention with the app rules, such user will not be entitled to a refund. Also users will not be refunded of any money they spent to increment their wallet. We advise users to pay extreme attention when using this feature, as we can’t deduct M-cash once it’s been added. Members of MM Arcade are free to vote and comment on contestant’s photos. Members are required to be civil and respectful in their comments, abusive and rancorous behaviour will not be tolerated. Defaulters would be issued with a warning and where the wrongful behaviour persists the offenders account may be deleted with or without notice. A contestant must obtain a minimum of a hundred (100) likes to be declared winner. In the event that a contestant receives the highest number of likes in a category, but the total number of likes is inferior to one hundred (100), the contestant will not be awarded any prize. Winners of the MM Arcade contest will be published on the game website and will stay on for a week, until they are replaced with new winners. Winners will be paid within a period of 30 days following the close of the voting session and presented with cash gifts and M cash bonuses.
Winners are also barred from joining any contests until four new winners have emerged since the day that the former were declared winners.

Allowed: make up, art and adornments for the purpose of beautification.
SMILE
Allowed: make up, art and adornments for the purpose of beautification.
N.B: We are not against the use of cosmetic surgery and photo editing software. We leave the decision to vote for such pictures at our users’ discretion.
PROOF, RETENTION AND STORAGE
The computer register stored on our systems in accordance with standard safety practices shall be considered proof of emails exchanged, registration forms sent, photos uploaded and other activity within the website. It is agreed that, in the event of a discrepancy between our computer registers and any paper or electronic documents in your possession, our computer registers shall be authoritative and controlling.
REASONS FOR DISQUALIFICATION
Any users found guilty of manipulating their votes through the use of fake, dubious, or bogus accounts will be disqualified with immediate effect and will not be allowed to join any contests until there have been six winners since the day of their disqualification.
CONTENT RESTRICTIONS
You may not upload, post, or transmit any video, photo, image, text, audio recording, or other work that;
(i) Infringes any third party’s copyrights or other rights (e.g. trademark, privacy, rights, etc);
(ii) Contains sexually explicit content or Adult/Child pornography;
(iii) Contains vulgar or offensive pictures showing genitalia;
(iv) Contains hateful, defamatory or discriminatory contents or incites hatred against any individual or group;
(v) Depicts unlawful acts or extreme violence;
(vi) Promotes fraudulent or dubious business schemes; or
(vii) Violates any law.
LINKS
As a convenience to you, the game website may contain links to websites operated by other entities (a “Linked Site”). If you decide to visit any Linked Site, you do so at your own risk, and it is your own responsibility to take all protective measures to guard against viruses or other destructive elements. MM Arcade has no responsibility to you with respect to any Linked Site and no Linked Site, regardless of the liking form (e.g. hotlinks, hypertext links, IMG links) is maintained, controlled, endorsed, monitored or otherwise governed by MM Arcade.
ELECTRONIC SIGNATURES
You agree to be bound by any affirmation, assent communication or agreement you transmit through the game website, including but not limited to any consent you give to receive communications from MM Arcade solely through electronic transmission. You agree that when in the future you click on “I agree or “I consent” or other similarly worded button, your agreement will be legally binding and enforceable. MM Arcade may revise its Terms or any of its Policies at any time and you hereby agree to be bound by such revised terms or policy. MM Arcade does not and will not assume any obligation to notify you of changes to its terms and policies.
ENTIRE AGREEMENT
These terms constitute the entire agreement between Michelini Media and Arts Limited and yourself with respect to the game website and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Michelini Media and Arts Limited in this regard. A printed version of the terms and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to the terms to the same extent and subject to the same conditions as other business documents and record originally generated and maintained in printed form. If for any reason a court of competent jurisdiction finds any provision of these terms or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as not to affect the intent of these terms, and the remainder of these terms shall continue in full force and effect. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.
